These Terms of Service (“Terms”) are an agreement between you and CMO Ignite LLC, a Wyoming limited liability company (“CMO Ignite,” “we,” “us” or “our”). They govern your use of cmoignite.com (the “Site”), our forms and booking tools, and our email and text message programs. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Our Services
CMO Ignite provides fractional marketing leadership and consulting. The Site describes those services and lets you contact us or book a call. Any consulting engagement is governed by a separate written agreement between you and CMO Ignite. If that agreement conflicts with these Terms, the agreement controls.
Using The Site
You may use the Site for lawful purposes only. You agree not to:
- submit false information, or impersonate any person or business;
- send spam, malware or anything that harms the Site or its visitors;
- try to gain unauthorized access to the Site, its servers or its accounts;
- scrape, copy or republish the Site’s content in bulk; or
- use the Site in any way that violates the law or the rights of others.
Text Messaging Program
CMO Ignite offers text messages to prospects and clients who opt in, for example by entering a mobile number and checking a consent box on our forms, or by texting us first.
- Program description: messages about your inquiry, scheduled calls and appointment reminders, our services and, if you opt in to them, marketing offers.
- Message frequency varies based on your interaction with us.
- Message and data rates may apply. Check your mobile plan for details.
- To opt out, reply STOP to any message. You will receive one confirmation message and then no further messages unless you opt in again.
- For help, reply HELP or email support@cmoignite.com.
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive text messages is not a condition of any purchase.
We handle your mobile number as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Intellectual Property
The Site and its content, including text, graphics, logos and design, belong to CMO Ignite or its licensors and are protected by copyright and trademark law. You may view and print pages for your own business use. You may not copy, modify, distribute or create derivative works from them without our written permission.
Information You Send Us
You are responsible for the information you submit through the Site. Please do not send confidential information until we have a written agreement in place. Ideas or feedback you send us may be used without any obligation to you.
No Guarantee Of Results
The Site’s content is general information about marketing and our services. It is not legal, financial or tax advice. Case studies and results describe past work for specific businesses; they are not a promise of similar results for yours, which depend on many factors outside our control.
Third-Party Services
The Site uses and links to services run by others, such as Calendly and Google. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
Disclaimer Of Warranties
The Site is provided “as is” and “as available.” To the fullest extent the law allows, CMO Ignite disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted, error-free or free of harmful components.
Limitation Of Liability
To the fullest extent the law allows, CMO Ignite and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site, even if we were told such damages were possible. Our total liability for any claim arising from the Site will not exceed one hundred US dollars ($100). This section does not limit liability under a separate written services agreement, which sets its own terms.
Indemnification
You agree to defend, indemnify and hold harmless CMO Ignite and its members, employees and contractors from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.
Governing Law And Venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be brought only in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
Changes To These Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and CMO Ignite about the Site.
